Copyright & DMCA Policy

MakeLabs respects intellectual property rights and expects all users of Audio Node to do the same. This Copyright & DMCA Policy explains how we handle copyright infringement claims and how rights holders may request takedowns of infringing content.

1. Our Commitment

MakeLabs complies with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and applicable copyright law. We operate under the DMCA's safe harbor provisions for service providers, which requires us to have a designated agent to receive infringement notices and a repeat-infringer policy.

We also comply with India's Copyright Act, 1957, as amended, and take down infringing content in response to valid notices under both frameworks.

2. Reporting Copyright Infringement

If you believe that content generated through or hosted on Audio Node infringes your copyright, please send a written DMCA Notice to our Designated Copyright Agent containing all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works);
3. Identification of the material claimed to be infringing, with sufficient information to locate it on our Service (e.g., URLs, account identifiers);
4. Your contact information — name, address, telephone number, and email address;
5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Send DMCA Notices to our Designated Agent:

We will acknowledge receipt of valid DMCA Notices within 3 business days and act expeditiously to remove or disable access to the allegedly infringing material.

3. Counter-Notice Procedure

If you believe material was removed from Audio Node in error or as a result of misidentification, you may submit a Counter-Notice containing:

1. Your physical or electronic signature;
2. Identification of the material that was removed and its location before removal;
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
4. Your name, address, and telephone number;
5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district if your address is outside the USA), and that you will accept service of process from the complaining party.

Upon receipt of a valid Counter-Notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed material at our discretion.

4. Repeat Infringer Policy

In appropriate circumstances, MakeLabs will terminate the accounts of users who are determined to be repeat infringers of copyright. We maintain records of all valid DMCA Notices received and will terminate accounts upon multiple substantiated complaints.

5. User Responsibility

By using Audio Node, you represent and warrant that:

• The text you submit as Input does not infringe any copyright, trademark, or other intellectual property right of any third party;
• You have all necessary rights and permissions to submit your Input for processing;
• You will not use Audio Node to generate audio versions of copyrighted text without authorization from the rights holder;
• You will not use Output audio in a manner that infringes third-party rights.

6. Misuse of DMCA Process

Filing a DMCA Notice with false or misleading information is a violation of law and these Terms. If you knowingly misrepresent that content is infringing, you may be liable for damages, including costs and attorneys' fees incurred by MakeLabs or the user affected by the false claim, under 17 U.S.C. § 512(f).
