Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of Audio Node (“Service”) operated by MakeLabs. This AUP is incorporated by reference into our Terms of Service. Violation of this AUP may result in immediate suspension or permanent termination of your account without refund.

1. Prohibited Content

You must not use Audio Node to generate audio that:

• Impersonates real individuals — Creating audio that mimics the voice, speech patterns, or identity of any real, living person without their explicit, documented, and revocable consent is strictly prohibited. This includes public figures, celebrities, politicians, and private individuals alike;
• Constitutes deepfakes or disinformation — Generating audio intended to deceive listeners into believing a real person said something they did not, or to spread false information about real events, persons, or organizations;
• Is defamatory or harassing — Content that makes false statements of fact about any identifiable person, or that is intended to harass, threaten, intimidate, or bully any individual or group;
• Facilitates fraud or scams — Audio designed to deceive financial institutions, businesses, or individuals for financial gain, including voice phishing (“vishing”), pretexting, social engineering, or impersonation-based fraud;
• Enables robocalling or spam — Bulk generation of audio for automated telephone solicitation campaigns, spam calls, or unsolicited mass audio messaging, whether or not such calls would violate applicable telecommunications laws;
• Promotes illegal activity — Content that encourages, facilitates, or instructs in any illegal activity under applicable laws;
• Incites hatred or violence — Content that promotes hatred, discrimination, or violence against any person or group based on race, ethnicity, religion, gender, sexual orientation, disability, national origin, or any other protected characteristic;
• Involves children sexually — Any content that sexualizes minors or constitutes child sexual abuse material (CSAM) in any form. Violations will be reported to law enforcement;
• Constitutes political disinformation — Fabricated audio attributed to political candidates, elected officials, or government authorities intended to influence elections or public opinion through deception;
• Violates third-party rights — Content that infringes any copyright, trademark, trade secret, or other intellectual property right of any third party.

2. Prohibited Technical Uses

• Using the Service via automated scripts, bots, or crawlers to circumvent rate limits or character quotas;
• Creating multiple accounts to accumulate free-tier allowances;
• Reselling, sublicensing, or white-labeling access to the Service or API without explicit written authorization from MakeLabs;
• Using Output audio to train, fine-tune, benchmark, or evaluate any AI model, voice synthesis system, or machine learning dataset;
• Attempting to reverse-engineer, extract, or reconstruct the underlying voice models or audio synthesis algorithms;
• Submitting sensitive personal data as Input, including but not limited to: medical or health records, government identification numbers, financial account numbers, biometric data, or passwords;
• Probing, scanning, or testing the vulnerability of the Service or any related network or system.

3. Voice Cloning & Consent

If Audio Node adds voice cloning features in the future, the following requirements will apply:

• You may only clone voices for which you have explicit written consent from the voice owner;
• You may not clone the voice of any person who is deceased without permission from the estate or legal representatives;
• You must retain proof of consent and provide it to MakeLabs upon request;
• Cloned voices may not be used to produce content the voice owner would not have consented to.

4. Sensitive Applications

Use of Audio Node in the following contexts requires particular caution and may be restricted:

• Healthcare: Do not use generated audio to deliver medical diagnoses, treatment recommendations, or emergency instructions without appropriate human oversight;
• Legal: Do not use generated audio to misrepresent legal proceedings, court orders, or official legal communications;
• Emergency services: Do not use generated audio to simulate emergency alerts, law enforcement communications, or government emergency broadcasts;
• Financial advice: Do not use generated audio to provide regulated financial advice without appropriate licensing and disclosure.

5. Enforcement

MakeLabs may, at its sole discretion and without prior notice:

• Remove or refuse to process any Input or Output that violates this AUP;
• Issue a warning for first-time minor violations;
• Suspend your account temporarily while an investigation is conducted;
• Permanently terminate your account and ban your email address and payment method;
• Report violations to applicable law enforcement authorities;
• Pursue civil remedies for damages caused by your violations.

We reserve the right to cooperate with law enforcement agencies and to disclose information about you if required to do so by law or if we believe disclosure is necessary to protect MakeLabs, our users, or the public.

6. Reporting Violations

If you become aware of any content or use that violates this AUP, please report it to us at support@audionode.dev with the subject line “AUP Report.” We take all reports seriously and will investigate promptly.

7. Updates to This Policy

MakeLabs may update this AUP at any time to address new threats, legal requirements, or misuse patterns. We will notify users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
